The Enumerated Powers Act (S. 1319) requires that each “Act of Congress shall contain a concise explanation of the specific constitutional authority relied upon” for its enactment. If the bill does not include a concise explanation of constitutional authority, a point of order will be available to any member in either the House or the Senate. In the Senate, the point of order will have to be decided by a vote of the Senate. The Senator raising the point of order will have up to one and half hours to debate the point of order or share that time with designees on their side. The floor manager of the underlying bill will have one and half hours for rebuttal or share that time with their designees. S. 1319 simply calls for Members of Congress to clearly justify legislation they sponsor in the Constitution.
